Digital Desk, New Delhi. The Supreme Court on Friday refused to entertain a plea seeking regulation on the production, distribution and consumption of alcoholic beverages and narcotic drugs in the national capital.
The petition, filed by advocate Ashwini Kumar Upadhyay, has sought a direction to the government to publish health warnings on liquor bottles – similar to the norms adopted for warning signs on cigarette packets – and use of electronic, print and social media. It should be advertised through this medium.
Upadhyay, Chief Justice U.U. Lalit that he will only pressurize liquor bottles to put warning labels on them as they are harmful. He further argued that even the slightest involvement in the matter would benefit the youth and requested for warning labels on the bottles.
Justice S. A bench of Ravindra Bhat and Justice Indira Banerjee said there are views from both the sides. Some people say that alcohol taken in moderation is good for health and no such things are said about cigarettes anywhere. The bench expressed its reluctance to entertain the petition. “Either you withdraw it or we will dismiss it,” the bench said. This is a policy matter.
Upadhyay requested the apex court to grant him liberty to approach the Law Commission in the matter. The bench said, no, we will only allow evacuation. Upadhyay withdrew his petition. The petition also sought a direction to the Delhi government to conduct a health impact assessment and environmental impact assessment of the production, distribution and consumption of alcoholic beverages and narcotic drugs under Articles 21 and 47 of the Constitution.
